What is parental responsibility?
In a nutshell, parental responsibility gives the parent the power to make important decisions about a child’s education, religion and health care, as well as other day-to-day decisions.
Married parents automatically have joint parental responsibility. Whereas, if parents are unmarried, only the mother will have automatic parental responsibility. Unmarried fathers can obtain parental responsibility by being named on the child’s birth certificate.
What is a child arrangements order?
In simple terms, it specifies who children should live with and the time they spend with the non-resident parent. It will also include a requirement for the parent whom the child lives with to make the child available to stay with or visit the other parent.
What is a specific issue order?
This allows the court to make a decision on a disputed issue, such as whether they should have a particular operation or what school they should attend.
What is a special guardianship order?
If a child cannot live with their birth parents, a special guardianship order can appoint one or more individuals to be the child’s special guardian.
Do step-parents automatically have parental responsibility?
No. To obtain parental responsibility, step-parents can enter into a parental responsibility agreement with the parents or apply to the court for a ‘lives with’ child arrangements order.
How many legal parents can children have?
Legally, a child can only have two parents. It is possible to extinguish the legal parentage of the birth parents by way of a parental or adoption order.
How many adults can have parental responsibility?
There is no limit on parental responsibility and it is shared between all the adults involved.
