Even though the defendant was incorporated outside of the UK, the team were able to adapt and successfully handle our six-figure claim. Before instructing Witan Solicitors, I had been advised by a national firm that I had a good case to bring to the Court regarding the joint ownership of my family care home. I was advised to seek a declaration from the Court on the grounds that the preference shares had capital and voting rights and that therefore I now owned, say, 95% of the company and my sister only owned 5%. This meant that because of a form mistakenly sent, my sister’s interest in the company would be reduced significantly. However, after receiving legal advice from Witan, I realised that I would need to take a different approach and put forward a different case. Following a conference with Counsel, we decided to go ahead with a trial to obtain evidence. However, following the cross-examination, we decided that the best course of action was to abandon the trial. The team informed the opponent that we would consent to a Tomlin Order to recover the costs, or if the matter could not be agreed upon, we would file a notice to stop the proceedings. I enlisted Witan Solicitors to represent me in a dispute about the replacement of trustees of a multi-million-pound family trust. This matter was extremely complex as I was appointed as a “Protector”, which is not recognised in English Law. To make matters worse, after receiving poor advice from my previous solicitors, I moved to remove instead appoint trustees who were seemingly independent. This led to a dispute about whether the trustees of the trustee funds should remain or whether different trustees should be appointed by the Court, as well as other matters relating to who should pay the costs of the dispute.
