Grandparents’ Rights Lawyers
As Featured In
Grandparents are more than just babysitters. They play an important role as caregivers, teachers and confidantes. Despite this, grandparents do not have an automatic right to see their grandchildren if their child divorces or separates from the other parent. While the family court does not always recognise the irreplaceable role that grandparents play, our specialist grandparents’ rights lawyers can help you maintain a relationship with your beloved grandchildren.
Generally, the court will consider that it is in your grandchild’s best interest to spend time with their extended family. While the time available for you to spend with your grandchildren may be limited, we will ensure that you are able to make the most of it.
Our highly trained family lawyers excel at helping grandparents secure access to their grandchildren, even in cases where their child does not have access to the grandchildren. In some cases, we can help grandparents become legal guardians or challenge a decision to relocate their grandchildren. Plus, with our mediation services, you can resolve disputes quickly. It is worth noting that it is now compulsory for grandparents to try and reach an agreement through dispute resolution methods before applying to the court.

Our Approach
We recognise the important role that you play in the life of your grandchildren, offering love, support, advice and guidance. Our expertise in family law is backed by years of experience helping grandparents maintain contact with their grandchildren, regardless of their family circumstances.
We always treat legal action as a last resort due to the costs involved. Instead, we discuss alternative options to engage parents from the outset. Generally, this is enough to secure access to your grandchildren. However, if contact is not secured, we will guide you through the legal process with sensitivity and ensure that the best possible outcome is achieved.
Voluntarily Agreeing on Access to Your Grandchildren
The most effective remedy for gaining access to your grandchildren is by making an agreement with the parents. Our highly trained solicitors can assist you during these discussions and ensure that your voice is heard. If an agreement is reached, it will set out when you can visit your grandchildren and whether you can make contact with them via phone or email, as well as any other provisions.
Applying For a Contact Order
At present, grandparents do not automatically have the right to apply to a court for a contact order. But the good news is that courts are gradually recognising the contributions grandparents make to the lives of their beloved grandchildren and, in some cases, may be willing to grant you the right to access your grandchildren.
Our grandparents’ rights solicitors will help you apply to the court for permission to apply for a contact order. The court will determine whether you can apply for a contact order based on:
- How much contact you previously had with your grandchild
- The appropriateness of the type of access you would like to have
- Whether contact with you will put your grandchild at risk
If the court grants permission, we will help you apply for a contact order that sets out what access you are allowed. If either parent objects to your application, you may need to attend a court hearing where the judge will decide whether to grant the contact order. If the order is granted, the parents will be required by law to allow you the contact specified in the order.
Non-Confrontational Dispute Resolution
To maintain positive relationships, it is in everyone’s best interests to resolve disputes through non-confrontational methods, such as:
- Collaborative law – This is an alternative approach to dispute resolution that involves both parents meeting to negotiate arrangements for moving forward following a divorce or separation. Grandparents’ rights can also be taken into account during these discussions
- Mediation – A meeting will be held between everyone involved, allowing arrangements for contact with the grandchildren to be discussed amicably
Our Mediation Service
While mediation helps families find resolutions in the most constructive and respectful way, it is not always right for everyone. If you have concerns about whether mediation is suitable for you, there is no need to worry. We provide free, initial, no-obligation consultations with our family law experts so you can decide whether mediation will allow you to achieve the best possible outcome.
