What is Family Mediation?
Managing family disputes by yourself can be pretty overwhelming, especially if the matter is sensitive. With emotions running high, it can be nearly impossible to reach a solution. But thankfully, mediation provides family members with a safe environment to discuss the issue amicably and reach an agreement.
This process involves working with an impartial mediator who will work with both parties to find a way forward and prevent the need to go to court.
What Can Mediation Be Used?
Mediation can be used to resolve a range of issues, including:
- Arrangements for children to decide which parent they should live with and how much time they spend with the other parent
- Arrangements for the time children spend with grandparents and other family members
- Civil partnership dissolution or separation agreements
- Child maintenance payments
- Division of finances and property
- Prenups and postnuptial agreements
Our Family Mediation Services
Our mediation lawyers provide the following services:
- Family mediation – As members of the College of Mediators, we always follow the highest standards. We excel at helping our clients find a way forward and achieve the best possible outcome
- Hybrid mediation – Our family mediation services can be combined with other services to help with complex and difficult situations
- Lawyer-supported mediation – Our family lawyers can support you throughout the mediation process and attend mediation sessions to provide you with advice in real time
Mediation Information Assessment Meeting
Before the joint mediation takes place, both parties attend their own mediation information assessment meeting. These individual meetings are designed to help the mediator understand what the issue is. They will also carry out a suitability and willingness assessment to determine whether the matter is suitable for mediation and whether the parties are willing to attend a joint session.
A joint session will then be arranged with the mediator. It is important to remember that the mediator is not there to take sides but simply facilitate an amicable discussion between the parties and help them reach an agreement. What’s more, the mediator cannot provide legal advice so it is wise for each party to seek independent legal advice before the session.
Benefits of Family Mediation
Aside from helping you start your future relationship as you mean to go on, family mediation provides a number of benefits, including:
- Increased control over how issues are resolved
- Increased flexibility as agreements can be altered if circumstances change
- Faster resolution of disputes
- Reduced stress
- Reduced emotional impact on any children involve
When Should I Consider Family Mediation?
To avoid disputes getting out of hand, it is important to seek mediation at the earliest stage. Even if you want to start court proceedings, many judges will refuse to hear your case if you cannot demonstrate that you have at least considered mediation beforehand.
It is worth noting that even if you have already been to court, mediation can still be effective. If your circumstances change, mediation can help you keep costs to a minimum and provide a safe space to resolve disputes amicably.
