Key Garden Laws to Know

Common garden disputes and legal difficulties arise over issues such as planning permission for buildings, parking rights, boundaries, fences, and hedges, noise, and party walls. It is important to understand the legal position so that you can avoid falling foul of the law. 

Garden Fencing Regulations and Back Garden Privacy Laws in the UK

New back garden privacy laws in the UK came into force in May 2025, allowing fences of 2 metres in back gardens or 1 metre in front gardens or adjacent to public paths, roads, or open space. Fences exceeding this height will need planning permission. Anything at the top of the fence, such as a trellis, is included in the measurement.

Fences can be a key source of disagreement between neighbours, and you should always discuss any intended alterations before you start work.

It is often difficult to identify in the title deeds where exactly a fence should be situated and who is responsible for it. The documents may indicate who the structure belongs to, but over time, someone could add a second fence on their side of the boundary. A solicitor will be able to advise you of the legal position and your best course of action. 

It is always best to try to deal with matters amicably wherever possible, and they will attempt to resolve matters without the need for litigation.

Party Walls

Party walls are those which are shared or which divide adjoining properties, including the wall of a semi-detached house, or a party structure such as a floor or ceiling between flats. The Party Wall Act 1996 provides rules relating to walls on boundaries between properties.

If you intend to carry out work to a party wall, such as inserting beams, underpinning, or inserting damp-proofing, you need to serve a formal written notice on your neighbour.

Similarly, they must be notified if you intend to build a new wall on the boundary between your properties or make excavations within three metres of an adjoining building if your excavations will be deeper than their foundations, or within six metres for some deeper foundations.

The notice period is two months for work to a party wall and one month for excavations or the building of a new wall. You should ensure that the notice is in the correct format, providing your neighbour with the required information, or it will not be deemed valid.

Your neighbour has 14 days to respond in writing, and can either consent or start a dispute. If they start a dispute, then you will need to appoint a surveyor to draw up a document known as a party wall award, setting out what work you are permitted to do, what hours you can do the work, and what measures will be taken to protect the property. You will be responsible for the surveyor’s fees.

If the correct process is not followed, you are at risk of an injunction being served on you, stopping your work. 

Trees and Hedges: Legal Considerations

Overhanging trees are often the cause of disagreement between neighbours. If a tree is overhanging your property, you can remove the overhanging parts. These should be returned to your neighbour’s property.

Ideally, you should talk to them before carrying out the work to avoid conflict.

If there is a Tree Preservation Order in place or you are in a Conservation Area, you need to apply for local authority permission before carrying out any work.

Work should not be carried out in nesting season, as it is a criminal offence to disturb nesting birds.

Garden Alterations and Buildings

Substantial landscaping may require permission, and you should check with your local authority before you start work, including if you intend to raise or lower the level of your garden by more than 30cm. 

If you will be paving more than 5 square metres, you must make provision for drainage, for example, by using permeable paving.

Outbuildings are generally allowed under permitted development rules, where:

  • They are not forward of the building line of the property
  • They are single-storey with a maximum eaves height of 2.5 metres and a maximum overall height of 4 metres for a dual-pitched roof or 3 metres for other types of roof
  • The building does not include a veranda, balcony or raised platform
  • No more than half of the area of land around the original house will be covered by the additions or other buildings
  • The land is not in a National Park or Area of Outstanding Natural Beauty
  • The property is not listed

You must also check your title deeds, as these often include restrictive covenants relating to buildings, fences, and walls, and if you breach these clauses, you could be required to remove any additions you have made.

Buildings that do not comply with the above will need the relevant consents, including local authority permission. This generally includes self-contained living accommodation or buildings that will be a home office or gym.

Where a building exceeds 15 square metres or contains sleeping accommodation, building regulations approval is likely to be needed. 

Garden Nuisances

Garden nuisances can spoil your enjoyment of your space. Examples include loud music, repeated dog barking, smoke, overgrown hedges that exclude light, invasive plant species, and rubbish. 

You should speak to your neighbour first to see if you can deal with the issue amicably. If this does not change matters, put the facts in writing to them, setting out what you believe is a reasonable solution.

Where the nuisance contravenes the law, you can contact your local authority’s environmental health department and ask them to intervene. They can measure noise levels, assess plants and rubbish and serve a notice on your neighbour requiring them to remedy the situation.

Rights of Way and Easements

Your property may have a right of way across it, or an easement allowing a third party to use the property for utilities, such as electricity cables, water supply, or sewerage pipes. You need to abide by these legal rights and ensure that rights of way remain clear and accessible. 

Planning Permission and Changes to Your Garden

Minor garden changes do not usually require planning permission, but if you are intending to erect a sizeable outbuilding or other structure, you will usually need consent. Your local authority will advise you of its rules and what types of permission you need to apply for.

Neighbour Disputes and Mediation

Neighbour disputes can escalate quickly if not handled well, and can become bitter and entrenched. This can make matters very stressful, as the person you are at loggerheads with is living next door. This type of dispute is notorious for being difficult to resolve, and you are strongly advised to try to negotiate early on to find a way forward.

A solicitor can advise you of your rights and set out the legal position for your neighbour clearly but firmly. It is often the case that once lawyers are involved, parties become more focused on finding a solution.

Where necessary, you can go to mediation. This is a faster and more cost-effective option than litigation, and has the added benefit of reducing conflict in many cases. A neutral mediator will work with you both to explore how the problem could be resolved.

Common Myths about Garden Laws

People often have the idea that a boundary on one particular side of the property belongs to one house, while that on the other side belongs to the other. This is a myth, and boundary ownership is often unclear. The first step is to check your title deeds, and then to explore who has actually maintained the boundary over the years. 

If ownership cannot be established, it is a good idea to try to find a solution with your neighbour, for example, sharing the costs of upkeep.

Wood, fruit and overhanging foliage from a neighbouring tree, hedge or plant belong to your neighbour. You can trim this, but the trimmings should be returned to their garden. Speaking to them first can avoid disagreement.

You do not necessarily have a right to light, and any rights there are apply only to buildings and not to gardens. If you have concerns about a new building that might obstruct your window, you should speak to a solicitor.

Dealing with Garden Disputes

If you have a dispute with your neighbour, it is always advisable to take a step back and try to deal with it as calmly and politely as possible. Once a dispute deteriorates, it can become all-consuming and be very difficult to resolve.

There are numerous examples of neighbours being involved in years of bitter and expensive litigation.

Do I need permission to plant a tree?

You do not generally need permission to plant a tree, but you should check your title deeds if you want to plant in an open-plan front garden area, as occasionally there are restrictions.

What can I do if my neighbour’s tree is overhanging my garden?

If your neighbour’s tree is overhanging your garden, you should speak to them and discuss the best approach for them. You have the right to remove the overhanging branches, which belong to your neighbour. You should not dispose of them without their consent.

Are there laws about the type of plants I can have in my garden?

Certain invasive plants should be avoided, such as some bamboos that spread rapidly. It is illegal to allow the spread of certain plants, including:

  • Japanese knotweed
  • Giant hogweed
  • Himalayan balsam
  • Three-cornered garlic
  • Rhododendron ponticum
  • New Zealand Pigmyweed (aquatic)

If any plant spreads from your property and causes a nuisance or damage, you could face a claim for compensation and the cost of removing it.

What should I do if I have a dispute with a neighbour over a fence?

It is often unclear who is responsible for the maintenance or replacement of fences or other boundary structures. Even if the deeds state who owns a fence, matters can become unclear over time if a second fence is erected alongside and the original fence is removed.

You are advised to seek legal help if the situation is not clear.

My neighbour’s fence is on my land, and I want to move it. What should I do?

It is important to try to deal with the situation without it escalating into a dispute. You should not simply remove it, as you could face a claim for criminal damage.

A solicitor can set out the legal situation for your neighbour in a formal letter and request that they move the fence. Where necessary, you should consider mediation to try to resolve matters with minimal conflict.

Litigation is a last resort. You will need evidence from your title deeds, witness statements over where the boundary has been over the years, and a surveyor’s report.
