FAQ
What do I need to prove to win a professional negligence claim?
You must show the professional owed you a duty of care, breached that duty by falling below the expected standard, and that this breach caused you a financial loss you can quantify. Expert evidence is often needed to prove the standard fell short.
How long do I have to bring a professional negligence claim?
The primary limitation period is six years from the date of the negligent act, under the Limitation Act 1980. If you did not discover the loss straight away, you may have three years from the date you found out, subject to a fifteen year longstop.
Can I bring a professional negligence claim on No Win No Fee?
Many professional negligence claims can be funded on a No Win No Fee basis, meaning you only pay our fees if the claim succeeds. Whether this is available depends on the strength of your case and the professional's insurance. We assess funding at your first consultation.
What is the loss of a chance doctrine in negligence claims?
Loss of a chance applies where negligence cost you the chance to succeed in an earlier claim, for example a solicitor missing a deadline. Rather than the full value, the court estimates the percentage chance it would have succeeded and awards damages accordingly.
What happens if the professional I want to sue is no longer in business?
Most regulated professionals carry mandatory professional indemnity insurance, which usually continues to respond to claims even after a firm has closed, or an individual has left the profession. We can help identify the relevant insurer and pursue the claim directly.
