Recovering Seized Items
To arrange the return of your items, you need to know:
- The name of the officer handling your case
- The date of your arrest
- The date your property was taken
- Your custody number

If that is unsuccessful, we can help you make an application to the Magistrates’ Court for the return of property seized by the police.
Common Items That Can Be Recoveread
Generally, personal items such as wallets are likely to be returned when you leave the police station. Phones and computers, on the other hand, may hold more evidential value so are likely to be retained. Similarly, clothes and other items that the police believe were used to help in committing an offence will be retained as evidence. On top of this, large amounts of money may be subject to investigation and may be subject to further proceedings even if the original investigation has concluded.
If the police retain your property for analysis, they will need to provide you with a copy of what they have seized before the case ends.
What If There is No Further Action?
If the investigation has concluded with no further action, seized items should be returned to you. While this process can be slow, our solicitors can ensure that your property is released to you as quickly as possible.
If the police refuse to return your property, we will help you make an application under Section 1 of the Police (Property) Act 1897. The court may issue an order to return the property to the lawful owner.
What if the Matter is Still Under Investigation?
If you have been released under investigation or on bail, you still have the right to recover your property under Section 22 of the Police and Criminal Evidence Act 1984. This act states that property cannot be held if a photograph or copy can be made. If the original must be retained by the police, there is still an obligation to allow access under Section 21.
If this is not allowed, our layers can escalate the application to a senior police officer or the court.
