    FAQs

    How long does a divorce take?

    Timescales depend on the stage you are at and whether you also need to resolve finances or children arrangements. Your solicitor can explain the divorce process from application to final order, and help you plan around the steps that can cause delay in contested cases.

    Do I need a solicitor if the divorce is uncontested?

    Even where you agree the divorce itself, disputes often arise later about property, pensions, and future financial claims. A solicitor can advise you on how to protect your position, including whether you should record a settlement in a court order.

    I am not married. What rights do I have if we split up?

    Unmarried separation can involve very different legal routes, particularly where property is concerned. Your solicitor can advise you on evidence, ownership issues, and whether a claim under TOLATA or another route may apply.

    Can I apply for an injunction against my ex-partner, and how quickly?

    The court can make protective orders such as non-molestation orders and occupation orders. How quickly this can happen depends on risk, evidence, and whether a without-notice application is appropriate. Your solicitor can advise you on the right type of order and what to expect at an urgent hearing and return hearing.
