If your case succeeds, you pay an additional success fee, which is agreed upon at the outset. If you lose, you only pay the discounted fees, not the success fee.

How Does a Discounted Conditional Fee Agreement Work?

2. Initial Agreement:
We would then agree on:

- A discounted hourly rate to be paid during the case.
- A success fee (a percentage or fixed amount) payable only if you win.
3. Case Progression:
Throughout the case, you pay the reduced hourly rate to cover the solicitor’s ongoing work.
4. Outcome:

- If you win, you pay the agreed success fee in addition to the discounted fees already paid. The success fee is typically capped to ensure fairness.
- If you lose, you only pay the discounted fees accrued, without any additional costs.
When Can You Ask for a Discounted Conditional Fee Agreement?
You can ask for a DCFA if:

- You have a strong case, that is a case which has prospects of success of over 60% which has been assessed by us or another Solicitor or Barrister.
- We are confident in the merits of your case and the need to mitigate the financial risk involved.
- You are involved in litigation as a Claimant where potential compensation or damages make a success fee reasonable.
We will typically assess the likelihood of your case succeeding before offering a DCFA and such an assessment is likely to be charged at our standard hourly rates.
What Happens If You Win?
If your case is successful:

- You pay the discounted fees (already paid during the case) plus the success fee agreed upon at the outset (which is deducted from your damages).
- Often, part of your legal costs, may be recoverable from the losing party, depending on the case type and court rules.
The total cost will be clearly outlined in your agreement, ensuring transparency.
What Happens If You Lose?
If your case is unsuccessful:

- You do not pay the success fee.
- You only pay the discounted fees accrued during the case.
- In many cases, you may also need insurance (commonly called After the Event insurance) to cover the opposing party’s legal costs, but this will be discussed during your initial consultation.
