What is No Win No Fee?

‘No Win No Fee’ is a legal term that refers to a conditional fee agreement (CFA) that you sign with your solicitors. It allows you to make a compensation claim without having to pay upfront fees. If you lose the case, you won’t have to pay any legal fees at all. Your lawyers only take a fee if your case is successful.

How does No Win No Fee work?

The ‘No Win No Fee’ model is designed to ensure that the fear of litigation costs harming your business won’t prevent you from bringing a claim and getting the compensation you are owed. This type of litigation funding is usually suitable for claims of over £125,000.

When you first seek legal advice from us, our expert No Win No Fee solicitor will make an estimate of how likely you are to win your case. If we establish you have over a 60% chance of winning, we can move forward with your claim. If you are happy with the terms of the claim and the legal fees you would have to pay if you win, we officially begin working on your behalf. 

Our team will ensure that you have the right litigation insurance (usually, an ATE insurance) to be fully protected from financial risks in case your claim is unsuccessful. Based on this policy, if you lose, you pay nothing at all. If you win, the losing party will pay the majority of the legal fees and the rest of the agreed amount will be deducted from your settlement. 

With no payment required upfront and all fees agreed in advance, you won’t have to worry about the cost of getting legal representation negatively impacting your business profit.

No Win Low Fee

If you are not eligible for No Win No Fee funding, in certain circumstances, we could offer to take your case on a No Win Low Fee basis. Under this type of agreement, you pay only part of our fee (based on hourly rates) and we get the rest of our legal fees paid only if we win your case. 

Litigation Funding

Even if your case isn’t suitable for a No Win No Fee or a No Win Low Fee agreement, we could help you secure other litigation funding. We work with reliable third-party litigation funding providers who could offer to pay your legal fees in exchange for a percentage of your winnings. Usually, this type of funding is suitable for high-value cases (over £250,000).

What happens if you win?

If you get the outcome you are hoping for, a win will result in a compensation settlement being paid to you by your opponent. They will also be responsible for paying a big portion of your legal costs. You will only have to pay the remaining part and that will be deducted from the amount you receive. 

If you win, you will have to pay:

• The ATE (After The Event) premium on your No Win No Fee insurance policy
• Minor legal costs that are not covered by the losing side
• A “Success Fee”  – a payment made to us to compensate for the risk we have taken by agreeing to not get paid if you lose. This is usually a percentage of your total legal costs. This sum is usually deducted from the settlement payout and we will try and agree on the amount with you before the deduction is made.
