Support for Midlands Employers

Midlands employers can benefit from working with a team that understands the region’s workforce, sectors and tribunal landscape. We advise businesses across manufacturing, logistics, construction, healthcare, education, retail and professional services.

Familiar with the Midlands (West) Employment Tribunal venues in Birmingham and the reforms to employment rights under the current government, we are well-placed to advise employers on matters of risk, compliance and grievance procedures.

When Employment Issues Land On Your Desk

One grievance, dismissal, or senior exit can take up weeks of management time. It can also create risk you cannot see until the claim arrives.

It is normal to have questions before you decide how far to escalate a workplace issue.

That is why we offer advice that is practical, calm, and focused on what matters to the business: protecting people, reputation, and finances.

Instructing Witan

Start with a short call to outline what has happened and what you need to achieve. In most cases, we’ll review key documents such as contracts, policies, investigation notes, and correspondence.

From there, we can help you map options, identify practical risks, and decide on a strategy. Depending on the circumstances, this may include revising documents, supporting internal processes, negotiating settlement terms, or preparing for tribunal proceedings.

FAQs

Fees depend on what you need and the stage the issue has reached. Costs should be discussed and agreed before work starts.

Administration may aim to rescue a company or achieve a better result for creditors than liquidation. Liquidation usually involves realising assets and closing the company. The right option depends on viability and creditor position.

Do I need a solicitor for a settlement agreement?

In many settlement agreements, the employee needs independent legal advice for the agreement to be valid. Employers often involve solicitors to draft and negotiate terms and manage risk.

How long do I have to make an employment tribunal claim?

Time limits are strict. Many claims must be started within around 3 months of the relevant event, and you usually need to notify Acas for early conciliation first. Exact deadlines depend on the claim type.

What is constructive dismissal?

Constructive dismissal is where an employee resigns and argues that the employer’s conduct was a fundamental breach of contract. Whether it applies depends on facts and timing.

Can I get a free consultation?

Witan Solicitors offers a free, no-obligation initial consultation in many matters. Availability may depend on the type of issue and urgency.
